Terms of Service

The terms that apply when you use KikuTune.

These Terms govern KikuTune accounts, Community features, cloud services, and related online functionality.

KikuTune is operated by Andrii Herasym, an individual developer in Illinois, United States, operating KikuTune under the KikuLabs brand. In these Terms, “KikuTune,” “we,” and “us” mean that operator.

By creating a KikuTune Account or using an online KikuTune feature, you agree to these Terms.

1. What KikuTune provides

KikuTune is Windows software for managing and enhancing compatible consumer audio devices. Core features may work locally without an account. Optional account, synchronization, entitlement, Community, and other cloud features may require sign-in.

Online features may change and are not guaranteed to remain available forever.

2. Software license and Store terms

The public KikuTune Windows application is distributed through the Microsoft Store.

If you acquire KikuTune through the Microsoft Store, your license to the Windows application is governed by the applicable Microsoft Standard Application License Terms. These Terms govern KikuTune accounts, Community features, cloud services, and related online functionality.

Third-party and open-source components remain subject to their own license terms.

3. Eligibility and accounts

You must be at least 16 and legally able to accept these Terms to create a KikuTune Account or use Community services. This age restriction does not apply to supported local, offline functionality that does not require a KikuTune Account.

You are responsible for activity through your authenticated account. You must not share security tokens, sell or transfer an account where transfer is unsupported, impersonate another person, or use automation to create accounts or manipulate service activity without permission.

If you believe your account is compromised, contact support@kikutune.com.

4. Acceptable use

You must not use KikuTune to:

  • break the law or violate another person's rights;
  • access another user's account, private content, or non-public information;
  • attack, overload, disrupt, scrape, or bypass KikuTune systems or protections;
  • distribute malware, credentials, private personal information, spam, or deceptive content;
  • manipulate likes, downloads, reports, rankings, licenses, or entitlements; or
  • create intentionally unsafe audio output, hearing risk, or device damage.

Nothing here limits rights that applicable law gives you to inspect, study, or interoperate with software.

5. Community presets

Publishing is optional and happens per preset. Private synchronization does not publish a preset.

You keep ownership of presets and original content you create. When you publish, you confirm that you have the rights needed to publish the preset and grant the license below, and that its public content does not unlawfully include another person's information or intellectual property.

You grant KikuTune a non-exclusive, worldwide, royalty-free license to host, copy, process, display, and distribute the published preset and its public metadata through KikuTune, and to let KikuTune users download it for personal use with KikuTune.

This license ends when the publication is removed, except for copies users already downloaded and limited records or backups reasonably needed for security, moderation, disputes, or legal obligations.

KikuTune may review reports and restrict, unlist, or remove content, or restrict an account, where reasonably necessary to enforce these Terms, protect users, secure the service, or comply with law. Automated screening may assist review but is not by itself a final legal determination.

Copyright, trademark, privacy, or other content complaints may be sent to support@kikutune.com.

6. KikuTune intellectual property

KikuTune software, branding, interface, documentation, and services are protected by applicable intellectual-property laws. Except for rights expressly granted to you, no ownership interest in KikuTune is transferred.

KikuTune is independent software and is not made by, sponsored by, endorsed by, or affiliated with Apple, Microsoft, Beats, Sony, or another device manufacturer unless explicitly stated. Third-party names and trademarks identify compatibility only.

7. Audio safety and compatibility

Loud sound can permanently damage hearing. Reduce volume before applying an unfamiliar preset or changing audio-processing settings.

Limiters and warnings cannot guarantee a safe listening level in every hardware, driver, firmware, operating-system, or volume configuration. You remain responsible for listening volume and device use.

KikuTune depends on Windows, Bluetooth hardware, audio drivers, firmware, vendor behavior, and third-party services. Compatibility may differ by device or change over time.

8. Purchases, subscriptions and refunds

The KikuTune app is free to download and use. KikuTune Pro is an optional paid subscription; no purchase is required to use KikuTune, and no account is required for the free features.

Price and billing. KikuTune Pro costs US$1.99 per month. The price is shown in US dollars and excludes any sales tax, VAT, or currency-conversion fee that your store, bank, or payment provider adds. The applicable total is shown before you confirm.

Free trial. New subscribers may start a seven-day free trial. Unless you cancel before the trial ends, the paid subscription starts automatically when the trial ends and the first charge is taken at that point. One trial per person and per account.

Automatic renewal. The subscription renews automatically for further one-month periods, charged at the start of each period, until you cancel. Renewal is a condition of continued Pro access.

Cancellation. You may cancel at any time, including during the trial. Cancelling stops the next renewal; it does not shorten a period you have already paid for, and Pro features remain available until that period ends. If your subscription is managed by the Microsoft Store, cancel it through your Microsoft account. Otherwise cancel in your KikuTune account settings or by writing to support@kikutune.com.

Refunds. If you are not satisfied, you may request a full refund of a KikuTune Pro charge within 14 days of that charge by writing to support@kikutune.com with the account email address and the approximate date of the charge. Refunds are returned to the original payment method. A refunded period ends Pro access immediately. Refunds are not offered for periods that ended more than 14 days ago, and repeated refund-and-resubscribe cycles may be declined. Where a purchase was made through the Microsoft Store, that store's own refund process applies and takes precedence.

Statutory withdrawal rights. If you are a consumer in the EEA or the United Kingdom, you have a statutory right to withdraw from a distance contract within 14 days. Because KikuTune Pro is digital content supplied immediately, you may be asked to expressly consent to immediate supply and to acknowledge that you thereby lose that statutory withdrawal right; the contractual 14-day refund above is offered regardless. Consumers elsewhere keep any equivalent local right.

Price changes. KikuTune may change the subscription price. A change is announced before it takes effect and applies only from a following billing period, giving you the chance to cancel first.

Store terms. Purchases made through the Microsoft Store are also governed by Microsoft's applicable billing, cancellation, and refund terms.

Disputed charges. If a charge appears that you do not recognize, please contact support@kikutune.com first — this is usually resolved faster than a bank chargeback.

Nothing in this section removes consumer rights that cannot lawfully be waived.

9. Service availability and changes

KikuTune may add, change, suspend, or discontinue features for product, security, compatibility, legal, or operational reasons. KikuTune does not promise uninterrupted service, permanent cloud storage, or permanent compatibility with every device.

Where reasonably practical, material changes affecting paid functionality will be communicated through the app, website, Store listing, or account service.

10. Suspension and appeals

KikuTune may restrict or suspend content, Community privileges, or account access because of material Terms violations, abuse, fraud, security risk, legal requirements, or harm to users or the service.

KikuTune may act without advance notice when immediate action is reasonably necessary. Where practical, KikuTune will explain the reason and provide a way to contact support@kikutune.com for review.

Suspension or account deletion does not automatically cancel a subscription managed by an external store.

11. Ending use

You may stop using KikuTune at any time. Where supported, you may unpublish content, export eligible account data, or delete your account.

KikuTune may terminate an account or online service access for serious or repeated violations, security threats, legal requirements, or discontinuation of the service.

Termination ends access to affected online features. Provisions concerning intellectual property, existing downloaded Community copies, disputes, warranty, liability, and other terms that by their nature should survive will remain effective.

12. Privacy

The KikuTune Privacy Policy explains how KikuTune processes information. It is separate from these Terms and has its own version.

13. Warranty

To the extent permitted by applicable law, KikuTune and its online services are provided “as is” and “as available.” KikuTune does not promise uninterrupted or error-free operation, permanent online storage, or compatibility with every device or Windows configuration.

Nothing in these Terms excludes warranties, remedies, or consumer protections that cannot legally be excluded.

14. Limitation of liability

To the extent permitted by applicable law, KikuTune is not liable for indirect, incidental, special, consequential, or purely economic loss arising from KikuTune or its online services.

KikuTune does not exclude or limit liability where applicable law does not permit it.

15. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law principles.

If you are a consumer, this choice of law does not deprive you of any mandatory consumer rights or protections that apply under the laws of the jurisdiction where you live and cannot lawfully be waived by contract.

16. Changes to these Terms

KikuTune may update these Terms when the product, services, business model, or legal requirements change. Material changes receive a new version and, where required, notice or acceptance. If you do not accept updated Terms, you may stop using the affected online features.
